KNOMIX TERMS OF SERVICE

1. Acceptance of Terms
By accessing or using Knomix ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Knomix ("we," "us," or "our").
2. Description of Service
Knomix is a knowledge management application designed to help users capture, organize, and retain information for personal learning and knowledge creation. We offer both free and paid subscription tiers.
3. Eligibility
You must be at least 13 years of age to use the Service. By using Knomix, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You agree to notify us promptly at support@getknomix.com if you suspect unauthorized access to your account.
- We reserve the right to terminate accounts that violate these Terms.
5. User Content
You retain ownership of all content you create, upload, or store within Knomix ("User Content"). By using the Service, you grant Knomix a limited, non-exclusive license to store and display your User Content solely for the purpose of providing the Service to you. We will not sell, share, or use your User Content for any other purpose without your consent.
6. Artificial Intelligence Features
Knomix may use artificial intelligence to process, analyze, or surface your content in order to enhance your experience. Where AI processing is used, it is performed through third-party API providers under commercial agreements that prohibit the use of your content to train or improve AI models. We do not use your content to train AI models, and we do not permit our AI providers to do so.
7. Acceptable Use
You agree not to use Knomix to:
- Upload or distribute content that is unlawful, harmful, or infringes on the intellectual property rights of others.
- Attempt to gain unauthorized access to the Service or other users' accounts.
- Use automated means to scrape, crawl, or extract data from the Service.
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service.
- Use the Service in any way that could damage, disable, or impair its operation.
8. Subscription and Payments
Knomix offers a free tier and paid subscription plans. By subscribing to a paid plan:
- You authorize us to charge the payment method on file on a recurring basis.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Refunds are handled on a case-by-case basis; please contact support@getknomix.com.
- We reserve the right to change pricing with reasonable advance notice.
9. Free Tier Limitations
Knomix offers a free tier subject to the following conditions:
Usage limits. Free accounts may be subject to limits on the number of notes, topics, artifacts, resources, or other content you can create or store. These limits may vary over time and will be communicated within the app or on our pricing page.
Feature access. Certain features — including AI-powered functionality — may be available exclusively on paid subscription plans. We reserve the right to adjust which features are available on the free tier at any time.
Account inactivity. Free accounts that have had no activity for 12 or more consecutive months may be deactivated. We will make reasonable efforts to notify you by email before deactivation. Deactivated accounts and their associated data may be permanently deleted 90 days after deactivation notice is sent.
Discontinuation of the free tier. We reserve the right to discontinue the free tier at any time. If we do so, we will provide at least 90 days' notice during which free tier users may export their data. After this period, accounts and their associated data will be permanently deleted.
10. Data Portability and Deletion
Export. You may export all content you have created in Knomix at any time using the data export feature available in your account settings. We will provide your data in a downloadable format.
Account deletion. You may delete your account at any time through your account settings. Upon deletion, your account will be immediately deactivated and your content will no longer be accessible. If you deleted your account by mistake, you may request reinstatement within 30 days by contacting us at support@getknomix.com. After 30 days, your data will be permanently deleted from our systems and cannot be recovered.
Right to erasure. If you are located in the European Union or California, you may have additional rights to request deletion of your personal data under GDPR or CCPA respectively. We will respond to verified deletion requests within the timeframes required by applicable law.
11. Intellectual Property
All elements of the Knomix platform — including its design, software, branding, and documentation — are the intellectual property of Knomix and protected by applicable law. These Terms do not grant you any rights to our intellectual property beyond what is necessary to use the Service.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and handle your data.
13. Early Access
Knomix is currently in early access. During this period:
- The Service is provided as-is and may contain bugs, errors, or interruptions.
- Features may be added, changed, or removed at any time without notice.
- We do not guarantee the stability, availability, or permanence of any data stored during early access. We strongly recommend using the data export feature regularly to maintain a local backup of your content.
- Pricing and plan structures may change when Knomix transitions to general availability. Early access users will receive advance notice of any such changes.
Your use of Knomix during early access constitutes acceptance of these additional conditions.
14. Community Standards
Knomix is built on the principle that original, honest thinking has value. To protect the integrity of the platform and its users, the following conduct is prohibited and may result in immediate account suspension or termination:
Harassment and abuse. Threatening, intimidating, or harassing other users, or using the platform to target individuals with abusive or harmful content.
Hate speech. Publishing content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
Explicit or obscene content. Uploading or distributing pornographic, sexually explicit, or otherwise obscene material.
Misinformation. Deliberately publishing false or misleading information with the intent to deceive others. Content that is clearly and prominently presented as satire, parody, or fiction — such that a reasonable person would not mistake it for factual claims — is excepted from this restriction.
Fraud and scams. Using the platform to conduct or promote scams, pyramid schemes, phishing, or any other fraudulent activity.
Spam. Distributing unsolicited, repetitive, or commercially deceptive content.
Malicious content. Uploading or distributing malware, viruses, or any content designed to harm, exploit, or gain unauthorized access to systems or individuals.
Impersonation. Misrepresenting yourself as another person, organization, or entity in a way that is intended to deceive. Parody or satirical accounts that clearly and prominently identify themselves as such are excepted from this restriction.
This list is illustrative and not exhaustive. We reserve the right to determine, at our sole discretion, what constitutes a violation of these standards.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, at our sole discretion. Reasons may include, but are not limited to, violation of these Terms, violation of our Community Standards, conduct that is harmful, fraudulent, or offensive, or any activity that we determine to be damaging to the trust and integrity of the platform or its users.
If your account is terminated for a violation of these Terms or our Community Standards, you will not be entitled to a refund of any prepaid subscription fees. If your account is terminated for any other reason, we will provide a prorated refund of any unused prepaid fees.
16. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
17. Limitation of Liability
To the fullest extent permitted by law, Knomix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service, even if we have been advised of the possibility of such damages.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify you by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
19. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.
